Great Lakes IT Management’s 10DLC Messaging Services Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before using the 10DLC messaging services ("Services") provided by Great Lakes IT Management ("we," "our," or "us"). By subscribing to or using our Services, you agree to be bound by these Terms and all policies incorporated herein by reference, including our Privacy Policy. If you do not agree with these Terms, please do not use our Services.

1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms. Your continued use of our Services will be deemed acceptance of any changes to these Terms.

We reserve the right to modify or update these Terms at any time without prior notice. Material changes will be communicated by posting the updated Terms on our website or by other appropriate means. Your continued use of our Services after such modifications constitutes your acceptance of the updated Terms.

3. Description of Services

Great Lakes IT Management provides 10DLC messaging services that allow you to receive SMS, MMS, and other types of messages on your mobile device. These Services may include transactional messages, alerts, notifications, and marketing communications. We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time without notice.

4. User Eligibility

You must be at least 13 years of age to use our Services. If you are below the legal age in your jurisdiction, you may use our Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms.

5. User Consent and Messaging

  • Opt-In: By subscribing to our Services, you expressly consent to receive messages from us on your mobile device.

  • Fees and Carrier Charges: You acknowledge that message and data rates may apply based on your mobile carrier’s plan.

  • Opt-Out: To stop receiving messages, follow the opt-out instructions provided in our communications (e.g., reply with “STOP”). Please note that opting out may affect your access to certain Services or communications.

6. Prohibited Conduct

You agree not to use our Services for any unlawful, fraudulent, or harmful purpose. Prohibited activities include, but are not limited to:

  • Sending unsolicited or spam messages.

  • Misrepresenting your identity or affiliation.

  • Attempting to disrupt or interfere with the functionality of the Services.

  • Violating any applicable laws, regulations, or third-party rights.

We reserve the right to suspend or terminate your access to the Services if you engage in any prohibited conduct.

7. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and without prior notice. You may also terminate your use of the Services at any time by following the provided opt-out instructions. Termination does not relieve you of any obligations incurred prior to termination.

8. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

  • Merchantability,

  • Non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Great Lakes IT Management shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your access to, use of, or inability to use the Services. Our total liability to you for any claim arising out of these Terms or your use of the Services shall not exceed any fees paid by you (if applicable).

10. Indemnification

You agree to indemnify, defend, and hold harmless Great Lakes IT Management, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Great Lakes IT Management operates, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Services shall be resolved through binding arbitration or in the appropriate courts, as determined by Great Lakes IT Management.

12. Miscellaneous

  • Entire Agreement: These Terms, together with any policies or documents referenced herein, constitute the entire agreement between you and Great Lakes IT Management regarding your use of the Services.

  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.

  • Waiver: The failure of Great Lakes IT Management to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision unless acknowledged and agreed to in writing.
